What is the 183-Day Rule?

The 183-day rule is the most common test for tax residency worldwide. In simple terms:

If you spend 183 days or more in a country during a fiscal year, you may become a tax resident of that country and owe taxes on your worldwide income.

Important nuances:

  • Fiscal year varies by country (UK: April 6, AU: July 1, most: Jan 1)
  • Day counting methods differ (any presence vs. midnight rule)
  • Not the only factor – economic ties, family, property also matter
  • Tax treaties may override simple day counting with tie-breaker rules

Our calculator uses the “any presence” method by default (most conservative approach).

USA Substantial Presence Test (SPT) Explained

The United States uses a more complex formula called the Substantial Presence Test:

Days in current year × 1
+ Days in previous year × 1/3
+ Days in 2 years ago × 1/6
= Total

You meet the SPT if BOTH conditions are met:

  • You were present at least 31 days in the current calendar year
  • The weighted total is ≥ 183 days

Our calculator automatically: Tracks the 3-year rolling window, applies the weighted formula, checks the 31-day requirement, and alerts you to potential issues.

Frequently Asked Questions

Is the tax residency calculator free?

Yes, 100% free. No signup, no credit card, no hidden fees. All features are available immediately, including CSV export/import, USA SPT calculation, and Schengen 90/180 tracking.

Is my data private?

Absolutely! All data is stored locally in your browser using localStorage. Nothing is sent to our servers. You can verify this by checking the network tab in your browser’s developer tools – you’ll see zero outgoing requests with your trip data. Click “Clear All Data” in settings to delete everything.

How accurate is the day counting?

Our calculator uses the “any presence” rule by default (if you’re in a country for any part of a calendar day, it counts as 1 day). This matches how most tax authorities count days. We correctly handle edge cases like year-spanning trips, fiscal year boundaries (UK April 6, Australia July 1), and leap years.

Does this work for all countries?

The calculator includes 16 pre-configured countries with correct fiscal year settings. For other countries, you can still add trips, but you’ll need to verify their fiscal year and day-counting method. Most countries use the calendar year (Jan 1 – Dec 31) and “any presence” rule.

What about tax treaties?

Tax treaties contain “tie-breaker” rules to resolve dual residency situations. Our calculator does NOT apply treaty rules – it only tracks physical presence. If you meet the 183-day threshold in multiple countries, consult a tax advisor to determine which treaty applies and how tie-breaker rules work in your situation.

Should I hire a tax advisor?

You should consult a qualified international tax advisor if you exceed 183 days in any country, are close to thresholds in multiple countries, have significant income/property, are changing tax residency intentionally, or are a US citizen living abroad (complex FATCA/FBAR rules). This calculator helps you identify issues and have informed conversations, not replace professional advice.
