If you spend 183 days or more in a country during a fiscal year, you may become a tax resident of that country and owe taxes on your worldwide income.

USA Substantial Presence Test (SPT) Explained
The United States uses a more complex formula called the Substantial Presence Test:
Days in current year × 1
+ Days in previous year × 1/3
+ Days in 2 years ago × 1/6
= Total
You meet the SPT if BOTH conditions are met:
- You were present at least 31 days in the current calendar year
- The weighted total is ≥ 183 days

We correctly handle edge cases like year-spanning trips, fiscal year boundaries (UK April 6, Australia July 1), and leap years.
Does this work for all countries?
The calculator includes 16 pre-configured countries with correct fiscal year settings. For other countries, you can still add trips, but you’ll need to verify their fiscal year and day-counting method. Most countries use the calendar year (Jan 1 – Dec 31) and “any presence” rule.
What about tax treaties?
Tax treaties contain “tie-breaker” rules to resolve dual residency situations. Our calculator does NOT apply treaty rules – it only tracks physical presence. If you meet the 183-day threshold in multiple countries, consult a tax advisor to determine which treaty applies and how tie-breaker rules work in your situation.
